Rebeca Zamora for EstadoDiario | Column “Compliance with Management and Supervisory Duties in Triangular Labor Relationships: Effects of Subcontracting”

Rebeca Zamora, director of the Regulatory Compliance & Criminal Law department, prepared a column for EstadoDiario on the duties of the parties involved in triangular labor relationships, i.e. subcontracting.

In her text, our director raises questions about the responsibilities that correspond to the main company in this type of relationship, the role and duty that should be exercised by the contractor company, and how they should instruct employees to adhere to good customs and ethics.

Regarding the Economic Crimes Bill, Zamora explained that the duties of direction and supervision will be increased. In addition, she adds that “the imposition of compliance measures on suppliers and contractors is justified in the duty of direction and supervision of the main company, which must take precedence over any effect that could imply any sanction.
