Recently our Director Carlos Frias has published a column for Estado Diario entitled: “New trends in jurisprudence regarding sanctioning resolutions issued by the Financial Market Commission (CMF).

Among other things, Carlos tells us: “Simultaneously, with rulings in other disciplines of administrative law (environmental, electrical, etc.) and a growing doctrine of the Constitutional Court, certain principles of sanctioning administrative law have been recognized, which gave judges legal tools to scrutinize the administrative basis of the contested resolutions. Thus, certain rulings have departed from merely legalistic, technical or deferential criteria to the administration and have resorted to legal categories developed by comparative doctrine and also by foreign courts”.
